1. General Provisions and Acceptance of Terms

This document sets out the terms governing the use of the Naff AI Coach platform and constitutes a public offer addressed to persons wishing to use the Platform's services.

By registering on the Naff AI Coach platform, creating an account, or beginning to use the Platform, the User accepts these Terms of Use and Public Offer.

By providing the appropriate consent during registration, the User confirms that they have read and agree to these Terms of Use and Public Offer and the Naff AI Privacy Policy.

If the User does not agree to these terms, they should not register for or use the Platform.

2. About the Platform

Naff AI Coach is a platform designed to help fitness coaches manage their clients and digitalize client management processes.

Through the Platform, a coach may:

• add, edit, archive, or delete clients;
• manage client goals;
• add and track body metrics;
• monitor client statistics;
• create and manage nutrition plans;
• create recipes and nutrition programs;
• assign tasks to clients;
• track progress photos;
• monitor clients' food journals;
• manage notifications;
• track referral statistics where a referral program is available;
• contact customer support.

3. Account Creation

To use the Platform, the User must register and create an account.

When registering, the User must:

• provide accurate and up-to-date information;
• maintain the security of their account;
• not share login credentials, passwords, or other access information with third parties;
• be responsible for activities carried out through their account.

If unauthorized access or a security breach is detected, the User should notify Naff AI support as soon as reasonably possible.

Naff AI reserves the right to temporarily restrict or suspend access to an account in the event of a security threat or violation of these Terms.

4. Coach Services and Responsibilities

Naff AI Coach provides coaches with technological tools to manage their clients.

The coach is independently responsible for their professional activities and relationships with clients.

The coach is responsible for:

• agreements with clients;
• services provided to clients;
• training and nutrition recommendations;
• tasks assigned to clients;
• taking into account each client's individual circumstances;
• lawfully obtaining and processing client data;
• maintaining the confidentiality of client data;
• the accuracy of information entered into the Platform.

Naff AI is not responsible for personal or professional relationships between coaches and clients, the quality of services, results achieved or not achieved, or disputes between the parties.

5. Adding Clients to the Platform

A coach may invite their clients to the Platform through Naff AI Coach.

The coach must ensure that they have the necessary rights and consents to enter client information into the Platform or invite the client to the Platform.

The coach must use clients' personal information solely for lawful purposes and for the provision of professional services.

Once a client joins the Naff AI platform, they may use the features available to them.

6. Referral Program

Naff AI may offer a referral program to certain users.

Where a referral program is available, a coach may:

• create a referral link;
• view available statistics regarding users registered through the referral link;
• track referral results.

Naff AI reserves the right to establish or modify the terms, mechanisms, and operation of the referral program.

Naff AI reserves the right to investigate suspicious activity, fake accounts, artificial registrations, or abuse of the referral system and invalidate relevant referral results.

7. Prohibited Use

Users may not:

• use the Platform for unlawful purposes;
• provide false or intentionally misleading information;
• attempt to gain unauthorized access to another user's account;
• disrupt or damage the operation of the Platform;
• distribute malicious software code or files;
• send spam;
• disclose client or other user information without authorization;
• create fake accounts;
• abuse the referral system;
• infringe the intellectual property rights of others;
• post unlawful, abusive, discriminatory, or harmful content;
• copy or modify the Platform without authorization or unlawfully attempt to determine the underlying operation of its technologies.

8. User Content and Materials

Users may upload or submit various materials to the Platform, including:

• profile photos;
• progress photos;
• food photos;
• comments;
• files;
• links;
• recipes;
• nutrition programs;
• task materials.

Users are responsible for the content they submit to the Platform.

Users retain their rights to content uploaded to the Platform.

Users grant Naff AI a limited right necessary to store, display, transmit, and technically process such content solely for the purpose of providing the relevant Platform features.

9. Intellectual Property

The Naff AI name, logo, brand elements, Platform design, interface, software, technological solutions, and other materials created by Naff AI are owned by Naff AI or the applicable rights holders.

Users may not copy, sell, distribute, modify, or commercially use such materials without prior authorization from Naff AI.

10. Health Disclaimer

Naff AI is not a medical service provider, and the Platform is not intended for medical diagnosis or treatment.

Nutrition plans, tasks, progress statistics, body metrics, and other Platform features are tools intended to assist with managing and tracking fitness-related processes.

Coaches are independently responsible for the training, nutrition, and other professional recommendations they provide to their clients.

Where necessary, a User or client should consult a qualified healthcare professional regarding health-related matters.

11. Artificial Intelligence Features

Naff AI may introduce artificial intelligence-based features to the Platform.

Recommendations, analyses, or other outputs generated by AI are provided as supplementary information and do not replace professional medical advice or diagnosis.

Coaches should evaluate AI-generated information based on their professional experience and each client's individual circumstances.

12. Service Availability

Naff AI takes reasonable measures to maintain the stable and secure operation of the Platform.

However, Naff AI does not guarantee:

• uninterrupted availability of the Platform at all times;
• immediate correction of all technical errors;
• uninterrupted operation of third-party services;
• the absence of issues related to the User's internet connection or device.

Certain Platform features may be temporarily unavailable due to maintenance, updates, or circumstances beyond Naff AI's control.

13. Account Restriction or Termination

Naff AI may temporarily restrict or suspend a User's account in the event of:

• a violation of these Terms;
• detected unlawful activity;
• a threat to the security of the Platform or other users;
• the use of fake accounts;
• attempts to damage the Platform;
• repeated abuse of the Platform.

Users may request deletion of their account through available Platform features or by contacting customer support.

14. Third-Party Services

Naff AI may use third-party services for the operation of the Platform, including hosting, cloud infrastructure, notifications, analytics, and other technological services.

Third-party services may be governed by their own terms of use and privacy policies.

15. Limitation of Liability

To the extent permitted by applicable law, Naff AI may not be liable for damages arising from:

• inaccurate information provided by the User;
• disputes between coaches and clients;
• professional recommendations provided by coaches;
• content submitted by Users;
• issues with the User's internet connection or device;
• interruptions in third-party services;
• the User's failure to maintain account security.

Nothing in this section excludes or limits any liability that cannot be excluded or limited under applicable law.

16. Changes to the Terms

Naff AI may update these Terms of Use and Public Offer from time to time.

In the event of material changes, Users may be notified through the Platform or other available communication channels.

Updated terms become effective on the date of publication or the date specified in the updated version.

Continued use of the Platform after updated terms become effective may, subject to applicable law, constitute acceptance of the updated terms.

17. Validity of the Public Offer

This Public Offer becomes effective upon publication by Naff AI and remains effective until replaced by a new version or withdrawn.

A User's registration on the Platform and confirmation of acceptance of these Terms constitutes acceptance of the Public Offer.

Naff AI reserves the right to amend or supplement this Public Offer.

18. Governing Law

These Terms of Use and Public Offer are governed by and interpreted in accordance with the laws of the Republic of Uzbekistan.

In the event of a dispute, the parties will first attempt to resolve it through negotiation and direct communication.

If a dispute cannot be resolved through negotiation, it will be handled in accordance with applicable law.
